The Election Petitions Tribunal for the Osun Gubernatorial Polls has overturned the victory of the Peoples Democratic Party’s Ademola Adeleke on Friday and declared Oyetola as governor.
This comes on the heels of the petition of the All Progressives Congress’ candidate, Adegboyega Oyetola, over the July 16 Osun governorship poll declaration by INEC.
Justice Tetsea Kume cited incidences of over-voting and non-compliance of the Independent National Electoral Commission (INEC) to the provision of the Constitution and the Electoral Act as the basis for the disannulment.
He subsequently deducted the over-voting observed from the votes scored by the candidates and declared that Oyetola won the election, having polled 314, 921, while Adeleke’s score came down to 290, 266.
Subsequently, he directed INEC to withdraw Adeleke’s certificate of return and issue another one to Oyetola who won a majority of the lawful votes.
